Welcome to Whisper Secrets (“App”), an anonymous social media platform. These Terms of Use (“Terms”) govern your access to and use of the App. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

1. Acceptance of Terms

By accessing or using Whisper Secrets, you affirm that you have read, understood, and agree to be bound by these Terms, as well as any additional guidelines or rules incorporated by reference. These Terms constitute a binding agreement between you and the App’s operators.

2. Eligibility

Age Requirement: Only users who are at least 18 years old are allowed to access and use this App. By using the App, you represent and warrant that you meet this minimum age requirement.
Legal Capacity: You must have the legal capacity to enter into a binding agreement in your jurisdiction.

3. Account Registration and Use

Anonymous Use: The App is designed to provide an anonymous social media experience. While registration details may be minimal, you remain responsible for all activities associated with your account.
Security: You are solely responsible for maintaining the confidentiality of any login credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use.

4. User Conduct and Prohibited Content

To ensure a safe and respectful environment for all users, you agree to adhere to the following rules:

Age Restriction: Only users aged 18 or older may use the App.
No Nudity: The posting of nudity or sexually explicit imagery that violates community standards is prohibited.
Legality: Do not post, share, or facilitate any activity that is illegal under applicable law.
Compliance with Store Guidelines: Do not post content that could cause the removal of the App from the Google Play Store, Apple App Store, or similar platforms.
No Impersonation: Do not impersonate or misrepresent yourself as a staff member, administrator, or any other individual with authority.
No Admin Blocking: Blocking administrators or interfering with the functions and communications of the App’s staff is forbidden.
No Sales of Illegal Content: Selling or promoting the sale of illegal, unauthorized, or counterfeit content is strictly prohibited.
No Prostitution or Illegal Sexual Material: The promotion of prostitution and the sale or distribution of unauthorized sexual materials are not allowed.
No Solicitation of Money: You must not ask for money or solicit payments from other users.
Restricted Hypertext Links: Hypertext links are not permitted in the public feed.
No Malicious Activity: Avoid any malicious use of the App that could harm other users or disrupt operations.
No Advertising: The public feed must not be used for advertising or the promotion of products or services.
Privacy of Social Media Information: Do not share information about personal or external social media accounts (e.g., Hush, Snapchat, Facebook, Instagram, TikTok, etc.) in the public feed.
No Phone Numbers: The disclosure or posting of phone numbers is prohibited.
Privacy of Personal Information: Do not post any personal, private, or sensitive information about other users.
Consent for Images: Do not post images of actual people without their explicit consent.
Zero Tolerance for Child Sexual Content: Any depiction, promotion, or facilitation of child sexual content is strictly forbidden.
Sexually Suggestive Content: Sexually suggestive posts are to be reserved for the “Whisper After Dark” feed and are not allowed in the main feed.
Unsolicited Sexual Material: Sending unsolicited sexual content or other sexual materials to other users is prohibited.
Racial Prejudice and Hate Speech: Do not post any material that promotes racial prejudice.
No Hate or Discrimination: Do not engage in hate speech, including racism, homophobia, religious discrimination, sexism, or any form of open prejudice against minority groups.

Violations of these rules may result in actions including, but not limited to, content removal, temporary suspension, or permanent termination of your account.

5. User-Generated Content

Responsibility: You are solely responsible for any content you post on or through the App.
Rights Granted to Us: By posting content, you grant Whisper Secrets a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, display, and distribute your content.
Content Monitoring: While we do not monitor all user-generated content, we reserve the right to remove or restrict access to content that violates these Terms or is deemed harmful.

6. Intellectual Property

Ownership: All intellectual property rights in the App and its content are owned by or licensed to the App’s operators.
Limited License: We grant you a limited, revocable, non-transferable license to access and use the App solely for personal, non-commercial purposes in accordance with these Terms.

7. Termination

We reserve the right, at our sole discretion, to suspend or terminate your access to the App, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is in violation of any applicable law.

8. Disclaimers and Limitation of Liability

No Warranty: The App is provided on an “as-is” and “as available” basis. We make no warranties, express or implied, regarding the App’s operation or the accuracy, reliability, or completeness of any information on the App.
Limitation of Liability: In no event shall the App’s operators be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.
Indemnification: You agree to indemnify and hold harmless the App’s operators from any claims, losses, damages, liabilities, or expenses arising from your use of the App or your violation of these Terms.

9. Modifications to Terms

We may update these Terms from time to time. Any changes will be posted on the App, and your continued use of the App after such modifications constitutes your acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

10. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction.
Dispute Resolution: Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration or in the courts of the appropriate jurisdiction, as determined by the App’s operators.
